РЕЗОЛЮЦИЯ

По итогам работы международной онлайн-конференции, посвященной 30-летию провозглашения государственной независимости Чеченской Республики Ичкерия 6 сентября 2021 года

23-25 ноября 1990 года в городе Грозном, столице тогдашней Чечено-Ингушской Республики, прошел общенациональный съезд чеченского народа (ОКЧН).

На этом съезде была принята «Декларация о государственном суверенитете Чеченской Республики (Нохчичоь)».

Исходя из этого решения, Верховный Совет Чечено-Ингушской Республики 27 ноября 1990 года утвердил решение съезда и объявил на законодательной основе государственный суверенитет республики.

6 сентября 1991г. Верховный Совет Чечено-Ингушетии под давлением протестующих объявил о самороспуске и создал Временный Совет из числа депутатов Верховного Совета с полномочиями организации и проведения новых выборов. Сразу же после этого ингуши провели общенациональный съезд с участием ингушских депутатов всех уровней, которые приняли решение о создании Ингушской Республики в составе России.

27 октября 1991 года прошли выборы президента и парламента Чеченской Республики. На этих выборах уверенную победу одержал Джохар Дудаев, который 1 ноября 1991 года первым президентским указом подтвердил ранее принятые решения Верховного Совета ЧИР о государственном суверенитете. 2 ноября 1991 года новоизбранный Парламент Чеченской Республики принял Постановление о государственном суверенитете Чеченской Республики.

Все эти события произошли до развала СССР и coответcтвoвaли как внутригосударственному законодательству, так и международному праву.

Чеченский народ и его лидеры обращались к высоким международным организациям с призывами стать посредниками в вопросах политического урегулирования спорных моментов между ЧР и РФ, а также к руководству России с предложениями различных вариантов мирного решения чеченского вопроса. Однако европейские государства, а также международные организации и ведущие политики устранились от рaзрешения российcко-чеченской проблeмы, ссылаясь на невмешательство во «внутренние дела» иного государства.

Это позволило политическим и военным силам России грубо проигнорировать основополагающие нормы и принципы международного права, беспрепятственно совершить акт агрессии против Чеченской Республики Ичкерия под надуманными предлогaми «наведения конституционного порядка», мнимой «борьбы с терроризмом» и развязать две колониальные войны, которые унесли сотни тысяч жизней мирных граждан, в том числе более 40 тысяч детей.

Международные институты, призванные защищать права человека и гражданина, занимают по сей день позицию «невмешательства», что в условиях нерешённой чеченской проблемы потенциально чревато новыми трагическими последствиями.

До сих пор также остаётся нерассмотренным заявление чеченской стороны в Международный Уголовный Суд о проведении беспристрастного, объективного расследования и привлечения к уголовной ответственности всех лиц, виновных в совершении преступлений против мирных граждан Чеченской Республики Ичкерия. Заявление официально передано в Канцелярию МУС 23 февраля 2018 года.

 

На основе вышеизложенного, мы, участники онлайн-конференции, призываем высокие международные организации (ООН, Совет Европы, ОБСЕ):

1. Требовать от государств выполнения принятых на себя международных обязательств по поддержке народа, определившего свой путь развития, согласно основным принципам и нормам международного права;

2. Отказаться от пресловутого предлога «невмешательства во внутренние дела», когда внешний агрессор в лице России отказался выполнять международные обязательства и проявил беспрецедентную жестокость в отношении чеченского народа, по сути совершая преступления против человечности и военные преступления с геноцидом древнего этноса чеченцев;

3. Провести объективное расследование обстоятельств двух войн, развязанных политическими силами России против Чеченской Республики Ичкерия в 1994 и 1999 годах, и определить круг лиц, виновных в этой трагедии;

4. Призвать Совет Безопасности ООН и Международный Уголовный Суд к рассмотрению следующих преступлений: агрессии, геноцида, преступления против человечности и военных преступлений на территории суверенной ЧРИ, исходя из фактов и заявления, поданного чеченской стороной 23.02. 2018 года.

RESOLUTION

upon the conclusion of the work of the International Online Conference Dedicated to the 30th Anniversary of the Declaration of Independence of the Chechen Republic of Ichkeria on 6 September 2021



On 23–25 November 1990 a National Congress of the Chechen People (NCCP) was held in Grozny, the capital of the then Checheno-Ingush Republic.

At this congress, a Declaration of the State Sovereignty of the Chechen Republic (Nokhchi-Cho) was adopted.

On the basis of that Declaration, the Supreme Soviet of the Checheno-Ingush Republic on 27 November 1990 approved the decision of the congress and confirmed the state sovereignty of the republic on a legislative basis.

On 6 September 1991 the Supreme Soviet of Checheno-Ingushetia, under pressure from protesters, announced its own dissolution and created a Provisional Council from among the deputies of the Supreme Soviet, with authority to organize and conduct new elections. Immediately after this, the Ingush held a national congress with participation of Ingush deputies of all levels, who resolved to create the Ingush Republic within Russia.

On 27 October 1991, presidential and parliamentary elections were held in the Chechen Republic. In these elections, Dzhokhar Dudayev won a landslide victory, and on 1 November 1991 with his first presidential decree confirmed the earlier resolutions on state sovereignty of the Supreme Soviet of the Checheno-Ingush Republic. On 2 November 1991 the newly elected Parliament of the Chechen Republic adopted a resolution on the state sovereignty of the Chechen Republic.

All these events took place prior to the collapse of the USSR and were in accordance with both domestic legislation and international law.

The Chechen people and its leaders appealed to high international organizations to mediate in the political settlement of matters of dispute between the Chechen Republic and the Russian Federation, and also addressed proposals to the Russian leadership for various options to ensure a peaceful solution of the Chechen issue. The European states, however, and also international organizations and leading politicians declined to become involved in resolving the Russo-Chechen problem, citing non-interference in the 'internal affairs' of another state.

This allowed the political and military forces of Russia to grossly ignore the fundamental norms and principles of international law, and to commit without hindrance an act of aggression against the Chechen Republic of Ichkeria under implausible pretexts of 'establishing constitutional order', a supposed 'fight against terrorism', and to unleash two colonial wars which claimed hundreds of thousands of civilian lives, including those of more than 40,000 children.

To this day, the international institutions whose duty it is to defend human and civil rights maintain a position of 'non-interference' which, given the unresolved state of the Chechen problem, is potentially fraught with new tragic consequences.

Up to the present time, the application of the Chechen side to the International Criminal Court to conduct an impartial, objective investigation and prosecution of all persons guilty of committing crimes against civilians of the Chechen Republic of Ichkeria has not been considered. The application was officially submitted to the Office of the International Criminal Court on 23 February 2018.



On the basis of the above, we, the participants of the Online Conference, call upon the high international organizations (the United Nations, the Council of Europe and the Organization for Security and Cooperation in Europe):

1. To require member states to fulfil their obligations in accordance with the basic principles and norms of international law to support a people which has determined its own path of development;

2. To renounce the discreditable pretext of 'non-interference in internal affairs', when an external aggressor in the shape of Russia has refused to fulfil its international obligations and has shown unprecedented brutality towards the Chechen people, in reality committing crimes against humanity and war crimes including genocide of the ancient Chechen ethnic group;

3. To conduct an objective investigation into the circumstances of the two wars unleashed by the political forces of Russia against the Chechen Republic of Ichkeria in 1994 and 1999, and determine the identity of those individuals responsible for this tragedy;

4. To call upon the UN Security Council and the International Criminal Court to consider the following crimes: aggression, genocide, crimes against humanity and war crimes on the sovereign territory of the Chechen Republic of Ichkeria on the basis of the facts and application filed by the Chechen side on 23 February 2018.
